The following terms and conditions shall be applied for services offered by Parpalandia Oy (hereinafter referred to as “Parpalandia”) and its partners in Rovaniemi, Parpalandia’s location at Rajalantie 200, 97140 Rovaniemi or any other area where the services are delivered.
TERMS DEFINITION
Self-Driving tours: tours on which driving on/to/between locations is secured by the customer.
Accommodation services: accommodation in premises owned by Parpalandia Oy.
Travel package combinations: services meeting the standards of a travel package or a linked travel arrangement, as defined in the EU Directive 2015/2302.
Daily tours: tours lasting less than 24 hours.
Multi-day tours: tours lasting longer than 24 hours or combinations of daily tours lasting longer than 24 hours.
Office hours: Monday – Friday, 09:00 -17:00

Services and Prices
The prices and the services offered and to be delivered by Parpalandia under these Terms & Conditions are set out in the descriptions for each service. The given prices include VAT according to the Taxation Laws and Regulations of Finland. Parpalandia reserves the right to adjust the prices in the event of any unforeseen increases in costs (including but not limited to increases in the amount of taxes, fuel prices, etc.) beyond the control of Parpalandia.
Pick-up from the pick-up places specified by Parpalandia is included in the price, unless otherwise mentioned. Parpalandia reserves the right to charge an additional fee for pick-up outside of the specified pick-up places / area. Self-driving tours do not include the pick-up service and the meeting place is at the Parpalandia’s address: Rajalantie 200, 97140 Rovaniemi.
To start any program, Parpalandia requires the full payment for at least 2 adults. Parpalandia keeps the right to cancel the program if the number of participants is lower than 2 adults. In case of such cancellation, the customers who booked the program are entitled to full refund.

Child Policy
Infants under 4 years old are free of charge on all the tours provided by Parpalandia. Parpalandia does not recommend the night tours and snowmobile tours for children younger than 4 years. Please, always take the weather conditions in Finland into consideration when booking a tour for young children.
Children that celebrated their 4th birthday, but are younger than 14 years old enjoy a discounted rate for majority of Parpalandia’s services. The price is set out in the description for each service.
Children younger than 18 years old must be always accompanied by an adult.

Reservations and Payment
Reservation received by Parpalandia is considered as confirmed upon reservation confirmation send by Parpalandia to the consumer. Payment options will be presented in our online store, or in case of reservations made on the spot, during the booking process. In special situations, it is possible to pay by a bank transfer.
All daily services reservations require 100% prepayment to be confirmed. Accommodation services, travel package combinations or multi tour reservations require at least 30% deposit for reservation confirmation. The full amount (100%) of accommodation services, travel package combination or multi tour reservation must be paid latest 1 month before the arrival, unless mentioned or agreed otherwise.
Parpalandia reserves the right to require a different amount of deposit, for example when a higher deposit is required by Parpalandia’s partner providing the accommodation or other services.

Cancellation policy
Cancellation policy for daily tours
All daily tours provided by Parpalandia can be cancelled for free latest 24 hours before the starting time of the tour. If a daily tour is cancelled less than 24 hours before the starting time of the tour, 100% of the amount payable is charged as a cancellation portion.
For daily tours provided by Parpalandia’s partners, Parpalandia follows the cancellation policy of the partner, set out in the description of each service.
Cancellation policy for multi-day tours
Multi-day tours provided solely by Parpalandia:
- Tour is cancelled 5 or more days prior to the tour, a cancellation fee of 50.00 euros per reservation is charged;
- Tour is cancelled 4 – 1 days prior to the tour, a cancellation fee in the amount of 30% of the payable amount is charged;
- Tour is cancelled less than 24 hours prior to the tour, a cancellation fee in the amount of 100% of the payable amount is charged.
Multi-day tours including services of Parpalandia’s partners:
- Tour is cancelled 8 or more days prior to the tour, a cancellation fee of 50.00 euros per reservation is charged;
- Tour is cancelled less 7 days prior to the tour, a cancellation fee in the amount of 100% of the payable amount is charged.
Payment conditions and Cancellation policy for accommodation services
During the winter season 1.11.-15.4., except between 11.12.-6.1.
- 30% reservation fee is charged to confirm a reservation;
- 100% of the total is charged 30 days prior to arrival;
- In case of cancellation, the paid reservation fees / deposits are not refundable.
During the peak season 11.12.-6.1.
- 100% reservation fee is charged to confirm the reservation;
- The reservation fee is not refundable.
Spring / Summer / Autumn 16.4.-31.10.
- 10% reservation fee is charged to confirm a reservation;
- 100% of the total is charged 7 days prior to arrival;
- In case of cancellation, the paid reservation fees / deposits are not refundable.
Payment conditions and cancellation policy for Travel Packages and tailor-made packages
All year, except between 11.12.-6.1.
- 30% reservation fee is charged to confirm a reservation;
- 100% of the total is charged 30 days prior to arrival;
- In case of cancellation, the paid reservation fees / deposits are not refundable.
During the peak season 11.12.-6.1.
- 60% reservation fee is charged to confirm a reservation;
- 100% of the total is charged 30 days prior to arrival;
- In case of cancellation, the paid reservation fees / deposits are not refundable.

Cancellation policy for subcontracted services
Notwithstanding the cancellation policy specified in the point 4 above, Parplandia reserves the right to follow the cancellation policy of its partners and subcontractors. In case such cancellation policy differs from the cancellation policy specified in the point 4 above, the customer shall be notified in the product description or otherwise before the confirmation of the reservation.

Cancellations or changes by Parpalandia
Parpalandia keeps the right to cancel the program for the safety reasons, weather conditions or other force majeure situations. In case of cancellation, the whole paid sum will be fully refunded to the payer. Parpalandia also keeps the right to change the route of the service, starting time of the service or the program itself to ensure the safety and satisfaction of the customers. The policy is valid for all – day tours and multi-day tours, accommodation services and travel package combinations.
Please, note that it is important for your safety and safety of everybody else, that you understand the safety instructions given in our tours, above all husky, reindeer, and snowmobile tours. If you cannot understand the safety instructions, Parpalandia and its partners reserve the right to modify the tour from self-driven to guide-driven, cancel or otherwise modify the tour and that without any refund.

Changes
All changes or alterations must be sent in writing within office hours in Finland. Changes are subject to the written approval of Parpalandia. Parpalandia reserves to charge the customer any extra costs incurred due to the requested change.

Pick-up service
Unless otherwise mentioned, Parpalandia provides pick-up service from 10km radius from Rovaniemi city center. Customers shall wait for their pick-up time at the specified pick-up point at least 5 minutes in advance. All the pick-up times are subject to 15-minutes difference. Customers are not entitled for a refund, if they are not present at the pick-up place at the pick-up time.

Service language
Unless otherwise stated or agreed, all services are provided in English.

Customer’s Responsibility
The customer is responsible for doing the best to avoid damage. Parpalandia is not responsible for an accident that has been caused by a slight negligence or customers own negligence. The customer is responsible for all the damages caused by their equipment, staff, performers or audience to Parpalandia or to any third party that is providing services together with or for Parpalandia. The customer must follow the instructions given by the staff of Parpalandia regarding the venues, gear, equipment, and safety. The customer is responsible for following the timetable of the program.

Parpalandia’s Responsibility
Liability for damages considering transportation is limited by the legislation of transportation (agreements valid in Finland or internationally). Parpalandia is not responsible for damages caused by any insuperable or unforeseen reason that is out of Parpalandia’s control (for example, acts of war, natural disasters, infectious diseases, strikes and similar events). On the occurrence of such event, Parpalandia shall inform the customers immediately of this and shall act in a manner that minimizes the damages suffered by the affected customers.
The customer shall have the right to receive compensation for any direct damage caused to a customer, his/her goods or property. Compensation of damages may not exceed the actual loss and are available only for loss which is proven by the aggrieved party, or where the amount of damages cannot be established with a sufficient degree of certainty, assessed by the court or tribunal.
Parpalandia shall not be liable for loss of profits or indirect, special, exemplary or punitive, or consequential damages. The claim for compensation with the proofs of damage shall be provided by the customer to Parpalandia in writing, within two weeks after the trip has ended. Parpalandia shall not be responsible for any valuables of the customers left in the public area while participating in the activities.
Parpalandia shall not be liable or assumed responsible for any claims, losses, damages, costs or other expenses arising out of inconvenience, loss of enjoyment, disappointment, distress or frustration, whether physical or mental.

Liability and Liability Insurance
Parpalandia has a General Third Party Liability for bodily injury and property damage.
Parpalandia shall exercise pro-activity, contingency, due diligence and appropriate health and safety measures in accordance with the laws and regulations of Finland and Finnish standards of recommended practices of program services at all times when delivering offered services under these terms and conditions.

Motor Liability Insurance
All the coaches or other motorized transport vehicles used in traffic in Finland must have valid Motor Liability Insurance. Compensation for damages or injury resulting from a road accident shall be covered by the valid Motor Liability Insurance of the vehicle that caused the accident. Motor Liability is governed by the valid laws of Finland.

Snowmobile Liability
All snowmobiles used in tours are insured as required by Finnish law and the coverage is subject to the above mentioned Motor Liability Insurance terms and conditions. Customers are held liable for damages caused during snowmobile tours, including damages caused to snowmobiles. The amount of the compulsory deductible expense is at most €900.00 per driver per snowmobile per incident. The driver of the snowmobile must be at least 18 years of age and in possession of a valid driver’s license in Finland. Finnish law prohibits driving a snowmobile under the influence of alcohol. Before the tour, the participants must sign a self-liability agreement.
Drivers have an option to reduce their liability by paying a self-liability waiver.
The self-liability waiver reduces the amount of maximum self-liability from 900€ to 100€. The self-liability waiver costs 20€ per driver and per safari and can be bought at our webstore for all our snowmobile safaris, or on spot before the safari. The self-liability waiver is personal.
As the responsible safari organizer, Parpalandia reserves the right to change the routing, schedules and duration of the excursions if necessary, due to prevailing weather conditions, or if deemed advisable due to safety reasons and the comfort of the participants. Parpalandia also reserves the right to discontinue the safari if a participant is seen as a potential danger to him/herself or to others, or is in poor health.
Snowmobile drivers must be able to present their valid driving license. Please note that police may check validity of the license during the tour!

Other injuries
Parpalandia shall only be held liable for personal injuries or material damage arising from accidents that have happened during the delivery of the offered services and which are caused by negligence of Parpalandia or its employees or subcontractors or by the provision of faulty equipment. Parpalandia is not liable for any accidental damage or injury which has to be indemnified under the travel insurance of a customer. Personal travel insurance is always highly recommended.
The customer shall acknowledge that adventure tours and the products and services offered by Parpalandia may involve a significant amount of risk to customer´s health and safety. The customer shall acknowledge that he/she has considered any potential risks to health and safety and assumed responsibility for all such risk.
Program services e.g. snowmobile and husky tours and weather conditions can be physically demanding and the participants may be exposed to different kinds of physical strain. In case the customer is having any illnesses or disabilities (for instance heart disease, asthma, diabetes, epilepsy, back or hip problems) that could affect his/her ability to take part in the services, or if she is pregnant, she/he should prior to participating any services consult medical experts about her/his ability to participate in the service in question. Should the customer have any illnesses or disability of this nature, he/she acknowledges that he/she participates in the service at his/her own risk.
The customer may be required to sign a form on the day of tour as required by Parpalandia to acknowledge his/her understanding of the risks to certain activities.

Pregnant women
Pregnant women should NOT participate on the snowmobile tours, including tours on which a sledge is pulled by snowmobile as the vibrations and exhaust fumes may be harmful to the human body. Failure to inform Parpalandia of the pregnancy shall release Parpalandia from any liability to the pregnant customer.
Parpalandia reserves the right to deny anyone participation in any aspect of a tour at any time where Parpalandia determines in its reasonable discretion that person’s physical or mental condition renders him/her unfit for using Parpalandia products or services or that the participation would represent a danger to him/herself or others.

Customers are held liable for injuries caused to animals by negligence. The amount of the compulsory deductible expense is at most €1000.00 per driver per animal per accident.

Photos and Videos
Parpalandia reserves the right to use any photograph/video taken on tours or programs organized by Parpalandia without the expressed written or oral permission of those included within the photograph/video. Parpalandia may use the photograph/video in publications or other media material produced; used or contracted by Parpalandia including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.
Any person desiring not to have their photo taken or distributed must contact booking@parpalandia.com in writing of his/her intentions and include a photograph. Parpalandia will use the photo for identification purposes and will hold it in confidence according to privacy policy.
Any person or organization not affiliated with Parpalandia may not use, copy, alter or modify Parpalandia’s photographs, graphics, videos or other similar reproductions or recordings without the advance written permission of an authorized designee from Parpalandia.

Force Majeure
Neither Party shall be held liable for any default, damage or loss due to a condition force majeure or to unreasonable impairment of the Party’s operations due to a similar cause (including but not limited to war, strike, weather, lack of snow, or other natural condition etc.). If encountered a force majeure condition, the Party shall immediately notify the other Party in writing thereof, and shall keep the other Party fully informed of the continuance of the force majeure condition and of any relevant change of circumstances whilst such force majeure continues. When encountered a force majeure conditions Parties shall also take all reasonable steps available to it to minimize the effects of the force majeure on the performance of their obligations under this contractual relationship.

Applicable Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the Finnish Law. The Finnish Courts shall have the exclusive jurisdiction to settle any dispute, controversy claim related to such a demand. The District Court of Lappi (in Finnish: Lapin käräjäoikeus), placed in Rovaniemi, shall be the court of first instance.

Severability
If any part, term or provision of these terms and conditions is partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.
